Client was in a verbal altercation with his wife in a hotel room. He followed her in his vehicle and later crashed.
The alleged victim claimed Client beat and strangled her in the hotel room. She claimed the hotel room was trashed in this fight and that he then followed her in his car and tried to run her off the road. The State also claimed he was impaired while driving.
During a two-day trial, the Defense raised several contractions with the alleged victim's testimony. These included lack of evidence of damage done to the hotel room, lack of witnesses despite claims of a loud fight in a public location, and incorrect information regarding the Client's vehicle and road conditions. The Defense also pointed to inconsistencies with the allegations and the medical reports from the victim when she went to the hospital.
Evidence of impairment was excluded from the trial due to the State being unable to provide a proper foundation to provide that information to the jury.
Verdict:Not Guilty on all charges
