{"id":24693,"date":"2012-01-30T14:32:10","date_gmt":"2012-01-30T14:32:10","guid":{"rendered":"http:\/\/the-tester.blawgcloud.com\/gps-tracking-devices-scotus-decision\/"},"modified":"2020-02-12T13:37:56","modified_gmt":"2020-02-12T18:37:56","slug":"gps-tracking-devices-scotus-decision","status":"publish","type":"post","link":"https:\/\/www.webblawmaine.com\/blog\/gps-tracking-devices-scotus-decision\/","title":{"rendered":"GPS Tracking Devices \u2013 SCOTUS Decision"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.webblawmaine.com\/blog\/wp-content\/uploads\/2020\/02\/gps.jpg\" alt=\"GPS Tracking Devices\" title=\"GPS Tracking Devices\" width=\"300\" height=\"177\" class=\"alignright size-medium wp-image-228\" \/>The 4th Amendment has been resuscitated!!\u00a0 Hopefully you recall back in September of 2010, I wrote about GPS tracking devices and a recent decision from the District of Columbia Circuit (&#8220;GPS Tracking Devices &#8211; A Warrant or Not A Warrant \u2013 That is Now the Question&#8221;).\u00a0 Well, on Monday we got our answer; kind of\u2026.<\/p>\n<p>In United States v. Antoine Jones, #10-1259 United States Supreme Court (SCOTUS) Justice Scalia wrote the decision of the Court, that said the Government\u2019s installation of the GPS tracking device on the suspect\u2019s vehicle to monitor it\u2019s movement was a search within the meaning of the 4th Amendment, and thus raised the issue of whether a warrant was required prior to the installation.\u00a0 I said \u201ckind of\u2026.\u201d because whether this search required a warrant was not answered.<\/p>\n<p>The Court rejected the government\u2019s argument that the attachment of a GPS device was not a search, but did not define how long or if you could track the vehicle with or without a warrant and what violates a reasonable expectation of privacy. The Court declined to opine on other details, like whether a warrant requirement applied to tracking cell phones.
